Terms of Service

By accessing or using AskGPT ("Service," "Platform"), operated by AskGPT Inc. ("Company," "we," "us"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization.

If you do not agree to these Terms, do not use the Service.

AskGPT is a Software-as-a-Service (SaaS) platform that allows businesses to:

• Crawl and index website content to train AI chatbots
• Deploy AI chatbots on websites via an embeddable widget
• Capture visitor leads and manage conversations
• Access analytics and improve chatbot performance over time

The Service is provided "as-is" and is subject to ongoing development. Features may be added, modified, or removed with reasonable notice.

Registration

You must register an account to use AskGPT. You agree to:

• Provide accurate and complete registration information
• Keep your credentials secure and confidential
• Notify us immediately of any unauthorized use of your account
• Be responsible for all activity that occurs under your account

Account Requirements

• You must be at least 18 years old to create an account
• One person or entity may not maintain more than one free account
• Machine-generated accounts or automated sign-ups are prohibited

Account Security

You are responsible for maintaining the security of your account. AskGPT will not be liable for any loss resulting from unauthorized access due to your failure to keep your credentials secure.

Subscription Plans

AskGPT offers the following paid plans:

Free Trial

New accounts receive a 14-day free trial with Starter plan access. No credit card is required to start a trial. At the end of the trial, you must subscribe to a paid plan or the account will be downgraded to read-only access.

Billing & Payments

• Subscriptions are billed monthly or annually in advance
• All prices are in USD and exclude applicable taxes
• Payments processed via Stripe. Card data is never stored on our servers.
• Invoices are emailed automatically on each billing cycle

Upgrades & Downgrades

• Upgrades take effect immediately with prorated billing
• Downgrades take effect at the next billing cycle

Refunds

We do not offer refunds for partial months or unused credits. Exceptions may be made for verifiable billing errors — contact us within 14 days of the charge.

Overages & Limits

If you exceed your plan's message limit, your chatbot will display a fallback message. Chatbots will resume when the next billing cycle starts or you upgrade your plan. You will receive email alerts at 80% and 100% of usage.

You agree to use AskGPT only for lawful purposes and in accordance with these Terms. You must NOT:

Prohibited Content & Activities

• Train chatbots on content that is illegal, defamatory, hateful, or deceptive
• Use the platform to impersonate individuals, companies, or brands
• Deploy chatbots designed to deceive visitors into thinking they are human
• Collect sensitive personal data (health, financial, government IDs) without explicit consent and proper legal basis
• Create chatbots for spam, phishing, or social engineering

Technical Restrictions

• Attempt to reverse-engineer, decompile, or access source code
• Use automated tools to scrape or excessively query our APIs beyond plan limits
• Interfere with or disrupt the platform's infrastructure or other users
• Circumvent security measures, rate limits, or usage caps
• Resell or sublicense the platform without a written reseller agreement

You retain full ownership of all content you submit to AskGPT, including:

• Website content crawled with your permission
• Documents and files you upload
• Custom Q&A pairs and chatbot training data
• Visitor conversation logs

License to AskGPT

By submitting content, you grant AskGPT a limited, non-exclusive license to process and store that content solely for the purpose of operating the Service for you. We do not use your content to train shared AI models.

Content Responsibility

You are solely responsible for ensuring you have the right to submit and process all content. You warrant that your content does not infringe third-party intellectual property rights or violate applicable laws.

AskGPT Platform

The AskGPT platform, including its software, design, branding, and documentation, is owned by AskGPT Inc. and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute any part of the platform without written consent.

Your Rights

Subject to your payment of applicable fees and compliance with these Terms, we grant you a limited, non-exclusive, non-transferable license to access and use the Service for your internal business purposes.

Feedback

If you submit feedback, suggestions, or ideas about the Service, you grant AskGPT an irrevocable, royalty-free license to use that feedback without restriction or compensation to you.

AskGPT uses Google Gemini AI and optionally OpenAI models to generate chatbot responses. Important terms regarding AI:

• AI responses are not guaranteed to be accurate. Always review your chatbot before deploying to visitors.
• We do not use your data to train shared or public AI models.
• AI providers process your prompts subject to their own usage policies. We recommend reviewing Google's and OpenAI's policies.
• You must not use AskGPT to generate content that violates Google's or OpenAI's terms of service.

Uptime Target

We target 99.5% monthly uptime for Starter and Growth plans. Enterprise plans include a 99.9% SLA with contractual remedies. Scheduled maintenance windows are excluded from uptime calculations.

No Warranty

The Service is provided "as is" and "as available" without warranty of any kind. We do not guarantee that the Service will be uninterrupted, error-free, or that defects will be corrected within a specific timeframe.

Force Majeure

We are not liable for delays or failures caused by circumstances beyond our reasonable control, including natural disasters, internet outages, government actions, or third-party service failures (including Google or AWS outages).

To the maximum extent permitted by applicable law:

• AskGPT shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business
• Our total liability to you for any cause of action shall not exceed the fees paid in the 12 months preceding the claim
• These limitations apply even if AskGPT has been advised of the possibility of such damages

Some jurisdictions do not allow limitations on implied warranties or liability, so some of the above limitations may not apply to you.

By You

You may cancel your account at any time from Dashboard → Settings → Delete Account. Upon cancellation:

• Your access to the Service ends at the close of the current billing period
• All your data will be deleted within 30 days
• No refunds are issued for the remaining subscription period

By AskGPT

We may suspend or terminate your account immediately if:

• You violate these Terms or our Acceptable Use policy
• Your payment fails and is not resolved within 7 days
• Your account is involved in fraudulent or illegal activity
• We are required to do so by law or court order

We will provide advance notice of termination where reasonably possible, except in cases involving abuse, fraud, or legal requirements.

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in Delaware. You waive any objection to the exercise of such jurisdiction.

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force.

We may update these Terms at any time. For significant changes, we will:

• Send an email notification to your registered address at least 14 days in advance
• Display a notice in the dashboard
• Update the "Last updated" date on this page

Your continued use of the Service after changes take effect constitutes your acceptance of the updated Terms. If you disagree with the changes, you may cancel your account before the effective date.
